4TEEN GAMES – Terms of Service (TOS)

1. Intellectual Property / Ownership

All materials that are part of the Service (including but not limited to designs, text, graphics, images, video, information, applications, software, music, sound, and other files, and their selection and arrangement) are protected by law. Unauthorized use of any materials that are part of the Service is prohibited in any form or by any means, in whole or in part, or in any way that involves altering, copying, distributing, framing, reproducing, republishing, downloading, displaying, posting, transmitting, or selling without prior written consent from 4TEEN GAMES, LLC. This does not apply to legally posted User Content (as defined below). Any derivative use of copyrighted material also requires express written permission from 4TEEN GAMES, LLC. Copying or redistribution of any non-compliant materials is expressly prohibited and may result in severe civil and criminal penalties. 4TEEN GAMES, LLC and/or its licensors retain all rights, titles, and interests (including copyright and other intellectual property rights) in materials submitted by 4TEEN GAMES, LLC to the Services. By using the Service or accessing any materials submitted by 4TEEN GAMES, LLC, you acknowledge that you do not acquire any ownership rights. 4TEEN GAMES, LLC grants you a personal, non-exclusive, non-transferable, revocable, limited license to use the Service for the sole purpose of viewing and using the relevant Services, and this license does not extend to any other purpose. Your license to use the Services is limited by these Terms.

2. User Content

You agree that you voluntarily publish content on the Service using the technology and tools provided by 4TEEN. You understand and agree that you may not distribute, sell, transfer, or license this content and/or applications in any way, in any country, or on any social network or by any other means without the express written consent of 4TEEN GAMES, LLC. You authorize 4TEEN GAMES, LLC to act on your behalf as the application operator. Data, text, graphics, photos, and their selection and arrangement uploaded to the Service (hereinafter referred to as "User Content") may be used in whole or in part by 4TEEN GAMES, LLC for commercial, non-commercial, and/or promotional purposes. Texts, graphics, and photos are uploaded by you and are the responsibility of the person who is the source of the User Content. Therefore, you are responsible for the files uploaded by users and for files made available through uploading, posting, or any other means, and 4TEEN GAMES, LLC is not responsible for such files. 4TEEN GAMES, LLC may or may not edit User Content and does not guarantee the accuracy, quality, or completeness of User Content submitted through 4TEEN GAMES, LLC applications. By using 4TEEN GAMES, LLC, you acknowledge and accept that you may be exposed to content that you may find offensive or objectionable. Under no circumstances shall 4TEEN GAMES, LLC be liable for any errors in User Content or for any loss or damage arising from the use of User Content. 4TEEN GAMES, LLC reserves the right to permanently remove and delete User Content with or without notice.

3. Coupons / Virtual Products

The Service may include the opportunity to purchase virtual in-game currency ("Virtual Currency") that may require you to use "real money". Virtual Currency can never be exchanged by 4TEEN GAMES, LLC or any other partner for real money, goods, or any other item of value. You understand that you do not own any rights or titles to the Virtual Currency or Virtual Game Items. Your purchase of Virtual Currency is final and non-refundable, non-exchangeable, and non-transferable at the sole discretion of 4TEEN GAMES, LLC. Purchasing, selling, or trading Virtual Currency outside of the Service is prohibited. This constitutes a violation of the Terms and may result in the termination of your Service account. 4TEEN GAMES, LLC reserves the right to modify, manage, control, and/or eliminate Virtual Currency at its sole discretion. Prices and availability of virtual game products are subject to change without notice.

4. Behavior / Usage Rules

This section sets forth the rules of conduct that must be followed on servers managed by 4TEEN GAMES, LLC®. Failure to follow any of the points below may result in penalties enforced by our team. The topics below present the fundamental rules that must be followed:

• Exploits

  Any player who uses programming errors in the game to gain an advantage will be permanently banned from our services. If an issue/bug is discovered, the user must immediately report it to our team via the support system on our website or through the official website of 4TEEN GAMES, LLC.

• Use of Illegal Programs (Cheats)

  If the use of illegal programs is detected in the game, users will be permanently banned from our servers immediately. Complaints can be made via the Tickets platform or on our official Facebook page.

• Communication Rules (Chat)

  If you report any kind of offensive behavior (racism, xenophobia, homophobia, insults, or any kind of aggressive behavior), penalties may range from in-game chat restrictions to permanent bans. If the victim seeks slander, insult, or harm, 4TEEN GAMES, LLC® shall not be legally liable for the incident.

• Refunds

  Refunds will be issued only if the purchased coupons / virtual items have not been used by the player at the time of the request.

5. Disclaimer of Warranties; Limitation of Liability

4TEEN makes no warranties or representations regarding the content of the Service or the content of any sites linked to the Service and accepts no responsibility or liability for the following:

  Errors, misunderstandings, or inaccuracies in content,

• (2)

  Any personal injury or property damage resulting from your access to and use of the Service,

• (3)

  Unauthorized access to or use of our servers, including any personal and/or financial information contained therein,

• (4)

  Any interruption or cessation of transmission or the Service,

• (5)

  Bugs, viruses, Trojan horses, or similar software transmitted through the Service by any third party, and/or

• (6)

  Errors or omissions in any content or for any loss or damage resulting from the use of any content.

In no event shall 4TEEN GAMES, LLC, its directors, officers, agents, contractors, partners, and employees be liable to you or any third party for any damages, including special, direct, indirect, incidental, punitive, or consequential damages. These damages may include loss of profit or loss of data arising from the use of the Service or other materials accessed or downloaded through the Service. Whether such damages arise under warranty, contract, or any other legal theory, and whether or not 4TEEN GAMES, LLC was advised of the possibility of such damages.

You agree that 4TEEN GAMES, LLC is not responsible for any offensive, aggressive, or unlawful conduct of user submissions or third parties, and you bear the entire risk of harm or injury from such content.

Finally, you agree to indemnify 4TEEN GAMES, LLC or face permanent suspension of services for the following:

  Violation of any provision of these Terms of Service,

• (2)

  Infringement of any third-party rights, including copyright, ownership, or privacy rights,

• (3)

  Any claim that any User Material has caused harm to any third party

• (4)

  Any content you have shared through the Service.
